ANTI-DOMA UPDATE

Our firm can help your same-sex spouse obtain his/her lawful permanent resident status.  Depending on the particular facts, such lawful permanent resident status can be obtained in the United States, or by obtaining an immigrant visa through the US Consulate in their home country.

We counsel our clients in the completion of the anti-DOMA (Defense of Marriage Act) I-601 waiver, I-601A provisional waiver, and with adjustments of status cases.

Section 3 of DOMA has been declared unconstitutional. Thus, the Secretary of Homeland Security directed United States Citizenship and Immigration Services (USCIS) to review immigration visa petitions filed on behalf of a same-sex spouse in the same manner as those filed on behalf of an opposite-sex spouse.
