Naturalization & U.S. Citizenship

_

N-400 naturalization, derivative citizenship claims, Consular Reports of Birth Abroad, and related work for long-term lawful permanent residents.

The Path from Green Card to Citizen

Naturalization is the last step for most lawful permanent residents, but it is also the step where old issues can surface for the first time. USCIS will re-examine your immigration history, any arrests or convictions, tax compliance, and good moral character. For many applicants the case is straightforward; for others it carries real risk. We evaluate the timing and the risks based on the current facts of the case and based on the current Immigration landscape.

What We Handle in Citizenship Cases:

  1. N-400 Applications:
    • Eligibility analysis under the five-year rule and the three-year rule for spouses of U.S. citizens.
    • Continuous residence and physical presence calculations, including absences over six months.

  2. Good Moral Character Review:
    • Arrests and convictions, dismissed charges, tax issues, child support arrears, and selective service registration.
    • Strategic advice on whether to file now, wait out the statutory period, or address an underlying issue first.

  3. Citizenship Through a Parent (N-600):
    • Derivative and acquired citizenship claims for clients who may already be U.S. citizens by operation of law.
    • Evidence of the parent’s citizenship, physical presence, and legal custody where required.

  4. N-648 Medical Disability Waivers:
    • Waivers of the English and civics requirements for applicants with qualifying physical or mental impairments.
    • Coordination with treating physicians on the medical certification.

  5. Interview and Test Preparation:
    • English, civics, and N-400 yes/no question preparation, tailored to the applicant’s comfort level.

  6. Denaturalization Defense:
    • Responding to USCIS or DOJ investigations into naturalizations the government claims were improperly granted.

  7. Posthumous citizenship in qualifying cases.
How We Approach a Citizenship Case:
  • An honest read on whether filing now is a good idea — not every LPR should rush the application.
  • Careful disclosure of past issues where required, with the legal analysis the adjudicator is looking for.
  • Interview accompaniment for applicants who want representation in the room.

Naturalization is the case where preparation most directly translates into a smooth interview. Done right, it is the capstone of a long immigration journey.
